Heard Sri Rakesh Kumar Singh, learned counsel for the petitioner and Sri Mahboob Ahmad, learned counsel for the respondent No.2.

The petitioner is facing recovery dated 15.05.2019 for a sum of Rs.6,76,584+ others as electricity dues.

Learned counsel for the petitioner submits that after the issuance of the aforesaid recovery he had deposited Rs.5000/on 20th September, 2019 and 25,000/- on 08.09.2019 thus only a sum of Rs.6,46,584/- is due and payable.

Sri Mahboob Ahmad, learned counsel appearing for the respondent No.2 submits that as the petitioner is ready and willing to pay the aforesaid amount in installments but the power of the Executive Engineer for fixing installments is very limited, the Court may itself fix the installments.

In view of the aforesaid facts and circumstances, we dispose of the writ petition with the direction to the petitioner to deposit a sum of Rs.1,46,584/+ re-connection charges by 15th November, 2019 and on deposit of the said amount, the electricity of the petitioner shall be restored. The balance amount of Rs.5,00,000/- shall be paid by the petitioner in ten equal installments of Rs.50,000/- each payable in the months of December, January, February, March, April, May, June, July, August, September. The last installment shall include all interest that may have accrued on the aforesaid outstanding

amount.

The petitioner in addition to the payment of the above installments shall continue to pay regular bills for the consumption of the electricity.

In the event of default in making payment of any of the installments, the benefit of this order would come to an end automatically.

The writ petition is disposed off.
