Heard Sri Rahul Srivastava, learned counsel for the petitioner, Sri Baleshwar Chaturvedi, learned counsel for respondent Nos.2, 3, 4, 5 and 6 and learned Standing Counsel for respondent No.1.

By means of this petition under Article 226 of the Constitution of India, the petitioner has prayed for a writ of mandamus to the respondents to grant multi-point residential electricity connection to the consumers/residents of Pushpanjali Upvan Colony, Saunkh Road, Palikheda, Mathura.

The petitioner before this Court is a welfare society of the residents of the colony. The contention on behalf of the petitioner is that there arose necessity for a multi point connection on the ground that there is only one point connection and there are several residents in the area who are consuming electricity and everyday the electricity consumed is chargeable but since the collection of the electricity dues from the different residents takes time, the association automatically gets into arrears towards the dues and in such view of the matter he submits that an application was forwarded to the Managing Director of Dakshinanchal Vidyut Vitran Nigam Ltd. and on which the Managing Director has already passed an order dated 31.10.2019 directing the Executive Engineer. We made a pointed query to the learned counsel appearing for respondent-Corporation as to why the matter was being lingered on, he submited that the petitioner was since standing in arrears towards the dues of electricity, the final action could not be taken in the matter. He further submitted that the petitioner

was also liable to pay the conversion charges for change of single point to multi point connection in the society. At this stage, learned counsel for the petitioner submits that he will clear all the arrears that are up to the tune of Rs.56,39,758/- shall be paid within a period of two weeks along with the conversion charges.

In view of the above undertaking and also the stand taken by the Corporation it is hereby directed in case if the entire dues along with conversion charges are deposited by the petitioner by 25.11.2019, the Executive Engineer concerned shall proceed to undertake the process of conversion which will be completed in any event in a further period of one month and from first of January, 2020, the Corporation shall ensure that the multi point connection is supplied to every resident of the society and it is also made functional and the electricity charges shall be taken from each individual on the basis of the meter installed under the multi point connection to the each resident of the society. It is also provided that the petitioner shall clear all the outstanding dues up to the date of the multi point connection getting functional by the respondent-Corporation within a further period of two weeks from 01.01.2020.

With the aforesaid observations and directions, the writ petition stands disposed of.
