Heard Sri Amitabh Singh, learned counsel for the petitioner, Sri Anand Tiwari, learned Counsel for the respondent nos.2 and 3, Sri Vikas Budhwar, learned counsel for the respondent nos.4 and 5 and Sri Yogendra Kumar, learned counsel for respondent no.1 and perused the record.
By means of this petition, the petitioner has sought for direction in the nature of certiorari to quash the draw of lots in respect of the locations at village Lakhanpur on Sambhal Gawan Road, Tehsil Sambhal, district Sambhal under category rural (OBC) at S.No.3675 and village Narangpur on Sambhal Gawan Road, Tehsil Sambhal, district Sambhal under category rural (OBC) at sl. no.3701 advertised by Indian Oil Corporation Ltd. vide advertisement dated 25.11.2018.
Learned counsel for the petitioner submits that the petitioner is the sole proprietor of the retail outlet of petrol and diesel in the name and style of M/s Kela Devi Kisan Sewa Kendra, Gawan to Sombhal Road, Sambhal and at present there are six retail outlets in the same locality/area. On 25.11.2018 advertisement was made by Indian Oil Corporation Ltd, Bharat Petroleum Corporation Ltd and HIndustan Petroleum Corporation Ltd for allotment of retail outlet but after issuance of said advertisement all the three companies have cancelled some locations advertised by them, hence present petition before this Court.
Learned counsel for the respondents have invited attention of the Court towards the order passed by coordinate Bench of this Court in identical matter i.e. Writ-C No.5432 of 2019 which was dismissed on 15.2.2019 against which petition for Special Leave to Appeal was filed before the Hon'ble Apex Court which too was dismissed by the Apex Court on 26.7.2019.
In view of the above, the petition lacks merit and is, accordingly, dismissed.
