This writ petition has been filed, inter alia, for the following reliefs:

"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondents not to construct road over the petitioner's Arazi No. 699, area 3 biswa and 15 dhoor and Arazi No. 819 Ka (M) area 2 Bigha 8 biswa and 15 dhoor situate at Village Patehera Kala, Tappa-84, ParaganaKantit, Tehsil Madihan, District Mirzapur unless the land in dispute belonging to the petitioner are acquired and compensation by the State of U.P. under the provisions of Land Acquisition Act. "

(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents to consider the representation dated 06.05.2019 of the petitioner."

Learned counsel for the petitioner has stated that the P.W.D. is encroaching on the land of the petitioner and making construction of road over it without acquiring it.

Learned counsel for the petitioner after arguing the matter for some time, has confined his prayer to the extent that the respondent no.2- District Magistrate, Mirzapur may be directed to decide the representation dated 06.05.2019 of the petitioner within the stipulated period.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent no. 2- District Magistrate, Mirzapur to decide the representation of the petitioner dated 06.05.2019 by a speaking order in accordance with law expeditiously preferably within a period of four weeks from the date of receipt of the certified copy of this order after hearing the concerned parties.
