Heard learned counsel for the parties.

Learned counsel for the petitioner states that the father of the petitioner took loan from respondent no.3 bank. He defaulted in payment of loan. Subsequently, he died. Now, the recovery is being pressed against the petitioner.

Learned counsel for the petitioner submits that the petitioner is willing and ready to pay the entire loan amount under the One Time Settlement Scheme, which has been launched by the respondent bank, but the bank is not extending the benefit of One Time Settlement Scheme.

Learned counsel for respondent no.3 states that the bank is ready to extend all the benefits of One Time Settlement Scheme to the petitioner.

In view of the statement made by the learned counsel for the petitioner, this writ petition is disposed of with a direction to the petitioner to appear before the respondent no.3 bank on 26.6.2019 at 11.00 a.m. and submit his application for One Time Settlement along with certified copy of this order. Thereupon, the respondent no.3 bank shall grant the benefit of One Time Settlement to the petitioner in accordance with the Scheme with respect to the loan taken by the father of the petitioner and the interest accrued thereon.

Learned counsel for respondent bank shall also inform about this order in writing to the respondent no.3 bank. The collection charges only to the extent permissible under law shall be charged by the bank.
