Heard learned counsel for the petitioner. Although the respondents are duly represented by counsel, none has appeared on their behalf even though the petition is taken up in the revised call.

The Corporation impugns the validity of the Award rendered by the Labour Court on 21 October 2005 answering a reference made by the appropriate Government in favour of the first respondent. The reference itself was with respect to the claim of the respondent workman to be granted permanent employment in the Corporation upon completion of 240 days of service. The stand of the Corporation before the Labour Court was that the engagement of the first respondent was as a part time Sweeper and the terms of engagement on permanent basis was governed by codified rules and regulations. It was further contended before this Court that mere completion of 240 days of service in a calendar year could not have led to the Labour Court granting the relief as claimed. The Court finds substance in the submissions addressed on behalf of the petitioner. Undisputedly appointments in the Corporation are governed by codified rules and regulations. In any case the Labour Court has not relied upon any provision statutory or otherwise which may have conferred a right on the respondent workman to claim permanent employment in the Corporation merely upon completion of 240 days of service. In that view of the matter,

the Court finds itself unable to sustain the award impugned.

The writ petition is allowed . The impugned award dated 21 October 2005 is hereby quashed.
