Heard Sri Suresh Kumar Maurya, learned counsel for the petitioner and Sri V. K. Yadav, learned Standing Counsel appearing for the respondents.
By means of the present petition, the petitioner has sought a direction to Respondent No.2, the Commissioner, Agra Mandal, Agra to decide the Appeal No. 841 of 2018 (Anurodh vs. Om Prakash and another) filed under Section 38(4) of the U.P. Revenue Code, 2006 within a stipulated period.
The order sheet of the case indicates that on 18.06.2018 the appeal was admitted for hearing and notices were issued to the opposite parties. The counsel for the petitioner submits that thereafter number of dates have been fixed and the matter has been continuously adjourned for various reasons, as such hearing of the appeal may be expedited.
Learned counsel for the petitioner further submits that the petitioner would appear before the court below in the pending matter and would not seek any unnecessary adjournment, and a direction may be issued for the pending matter to be decided within a reasonable time period.
Learned Standing Counsel appearing for the respondents has no objection to the prayer so made.
With the consent of the parties the petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment, it is expected that the court below would make an endeavour to decide the aforesaid case expeditiously in accordance with law, preferably within six months from the date of presentation of a certified copy of this order, if there is no other legal impediment.
