Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent Nos.1 to 3 and Smt. Anjali Upadhya, learned counsel for respondent No.4.
This writ petition has been filed with the following prayers:-
"(i) Issue a writ, order or direction in the nature of Mandamus commanding the respondents particularly respondent No.4 to grant the physical possession of 620 Sqare meter to the petitioner due to acquisition of his hand i.e. plot No.91 area 1.0037 hectare, 104 area 0.0379 hectare and 110 area 0.0139 hectare situated at village Murshadpur, Pargana & Tehsil Dadri District Gautam Budh Nagar.
(iii) Issue any other writ, order or direction which this Hon'ble Court deems to fit and proper in the circumstances of the case.
(iv) To award the cost of the writ petition to the petitioner."
On 21.5.2019 another Co-ordinate Bench of this Court had passed an order directing the learned counsel for respondent No.4 to seek instructions.
When the matter was taken up today, Smt. Anjali Upadhya, learned counsel for respondent No.4 submitted on the basis of written instructions received by her from respondent No.4, which have been taken on record, that the proceedings for delivery of possession of 10% land to the petitioner in compliance of the judgement passed in Gajraj Singh and others v. State of U.P. and others, 2011 (11) ADJ 1, vide judgment dated 20.10.2011 have commenced and the petitioner shall be delivered the possession of the same within three months. In view of the statement made by Smt. Anjali Upadhya learned counsel for respondent No.4, no further order is required to be passed in the writ petition. The writ petition is disposed of accordingly.
