Supplementary affidavit has been filed today by the learned counsel for the petitioner is taken on record.
This writ petition has been filed, interalia, for the following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned E-Tender No. 10191001 dated 11.04.2019 issued by the respondent no. 3 (Annexure No. 28 to the writ petition).
(ii) Issue a writ, order or direction in the nature of mandamus restraining the respondents from undertaking any further proceedings in pursuance of the impugned E-Tender No. 10191001, dated 11.04.2019 issued by the respondent no. 3."
At the very outset, learned Standing Counsel Sri Rajnish Kumar Rai, on the basis of the instructions received by the Railway Department, has stated that the Tender No. 10191001 floated on 11.04.2019 for the quantity 593 is altogether different and in addition to earlier Tender No. 101810202 floated on 22.02.2019 for the 623 nos.
The copy of the instructions dated 09.05.2019 placed before this Court by the learned Standing
Counsel is taken on record.
In view of the aforesaid statement made by the learned Standing Counsel, we do not see any justification to interfere in the matter.
The writ petition is, accordingly, dismissed.
