Heard learned counsel for the petitioner and learned Standing Counsel.
Petitioner claims to be allottee of fair price shop of Gram Nasirpur, Bhaisrolli, Tehsil Sikarpur, District Bulandshahar. The licence of the petitioner was cancelled by the respondent no.4 by order dated 15.01.2019 against which, petitioner has preferred statutory appeal No. C201911000000200 under Section 13(1) of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Act before the Joint Commissioner (Food) Meerut Division, Meerut wherein the stay application of petitioner has been rejected by the Commissioner by order dated 29.01.2019. The order dated 29.01.2019 is impugned in the writ petition.
However during the course of argument, learned counsel for the petitioner states that appeal of the petitioner may be decided within time bound period.
Learned Standing Counsel submits that no useful purpose would be served by keeping the writ petition pending.
Considering the facts and circumstances of the case and with the consent of the parties, without adverting into merits of the case, the writ petition is disposed of with a direction to the respondent no.2 to decide the appeal No. C201911000000200 of the petitioner expeditiously, preferably within a period of six months from the date of production of certified copy of this order.
