"Heard Sri Samarath Singh, learned counsel for the petitioners.

Learned Standing Counsel has accepted notice on behalf of respondent Nos.1 to 7 and Sri Rajesh Yadav, Advocate has accepted notice on behalf of respondent No.8.

The petitioners have preferred the present writ petition inter alia with the prayer to issue a mandamus commanding the respondents specifically the Consolidation Officer-II, Sadar, Muzaffarnagar to complete the consolidation proceedings as per the law expeditiously, of the area in question, where the petitioners land is situated in view of the order dated 28.8.2018 passed by the Settlement Officer of Consolidation, Muzaffarnagar.

It is argued by the counsel for the petitioners that by the order dated 28.8.2018 passed by the Settlement Officer of Consolidation, Muzaffarnagar, certain direction were given to the Consolidation Officer, Sadar (IInd), although, a considerable time has already lapsed. The aforesaid order passed by the Settlement Officer of Consolidation dated 28.08.2018 was not complied. In this regard, representations were also made by the petitioners before the Consolidation Officer from time to time. It is further argued that the representations were also made by the petitioners before the Consolidation Commissioner U.P., Lucknow, but till date, no decision has been taken on the same.

As prayed, ten days' time is granted to the learned Standing Counsel to seek instructions in this matter.

Today when the matter is taken up, instructions received by learned Standing Counsel form the Office of Deputy Director of Consolidation Muzaffar Nagar dated 06.12.2019 has placed before the Court and the same is taken on record.

It is argued by learned Standing Counsel on the basis of instructions that considerable time be granted to the respondent No.5/Consolidation Officer II Sadar Muzaffar Nagar to complete the consolidation proceedings.

Heard learned counsel for the parties. With the consent of learned counsel for the parties, the present writ petition is disposed of at the admission stage itself.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.5/Consolidation Officer II Sadar Muzaffar Nagar to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of ight months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
