Heard Sri Birendra Singh, "Singraur" learned counsel for the petitioner and learned Standing Counsel for the respondents.

The petitioner has preferred the present writ petition with the prayer to issue a mandamus directing the respondents to consider the case of the petitioner for the promotion of suitable post in the department. A further prayer is also made to issue a mandamus directing the respondents to released full salary of the petitioner from 20.07.2018 to 27.02.2019.

Facts in brief as contained in the writ petition are that the petitioner was appointed on the post of Gram Panchayat Adhikari, in District Kaushambi on 03.09.1989. The petitioner was suspended by respondent No.3 namely Zila Panchayat Raj Adhikari, Kaushambi by order dated 20.07.2018. Aggrieved against the said order of suspension, the petitioner preferred a writ petiton before this Court being Writ A No.4032 of 2019 (Raj Kishore Bhartiya Vs. State of U.P.. and others). During the pendency of the writ petition, the order of suspension was revoked by the respondents vide its order dated 27.02.2019. In view of the same, following order was passed by this Court on 29.3.2019 in the aforesaid writ petition :-

"It is contended by learned counsel for the petitioner that although the order of suspension has already been revoked on 27.2.2019, till date the petitioner has not been paid his full salary for the period when the petitioner was suspended.

I have perused the order dated 27.02.2019 passed by District Panchayat Raj Officer, Kaushambi by which the order suspension passed against the petitioner was revoked. it is stated in the aforesaid order that the petitioner was permitted to his his duties with the condition that departmental proceedings will continue against him. It is further stated in the order that difference of salary will be paid to the petitioner only after final decision is taken in the departmental proceedings."

Heard learned counsel for the parties and with the consent of learned counsel for the parties, this petition is disposed of at the

admission stage itself directing the respondent No.3/District Panchyatraj Officer, Kaushambi to conclude departmental proceedings pending against the petitioner expeditiously and preferably within a period of six months from the date of presentation of certified copy of this order.

The petitioner is also directed to participate in the inquiry without taking any unnecessary adjournment.
