Heard Sri Sunil Kumar Srivastava, learned counsel for the petitioner, learned Standing Counsel accepted notices on behalf of respondent Nos. 1 and 2 and Sri Akhilesh Chandra Srivastava, learned counsel put his appearance on behalf of respondent Nos.3 and 4.

Facts as contained in the writ petition are that the petitioner duly submitted his online application form for appointment on the post of Assistant Teacher and the application form of the petitioner was duly scrutinized and thereafter the petitioner was issued admit card. On the basis of the same, the petitioner duly participated in the written examination which was held on 27.5.2018. In the said written examination, the petitioner secured 66 marks.

Dissatisfied with the result, the petitioner submitted a representation as per the provisions of the Regulatory Authority. It was found that by way of mistake, in certain questions, marks were not awarded to him but in that regard no action was taken by the respondents on the representation, the petitioner preferred a writ petition being Writ A No.24727 of 2018 (Avadesh Yadav Vs. State of U.P. and others) decided on 22.11.2018 in which directions were issued to the Secretary, Examination Regulatory Authority to consider the claim of the petitioner regarding re-evaluation/re-examination in the light of the observations made in the judgement and order dated 30th October, 2018 passed in Writ A No.24727 of 2018 (Aniruddh Narayan Shukla and 118 others Vs. State of U.P. and 3 others).

Pursuant to the same, copy of the petitioner was re-examined and the petitioner was awarded 67 marks and found selected. The name of the petitioner was contained at serial No.4028 in the select list. Subsequently, the petitioner was called for counselling on 8.3.2019 and 9.3.2019 but the petitioner was not able to attend the said counselling due to his examination of T.G.T. (Social Studies), which was conducted by U.P. Secondary Education Service Commission on 8th March, 2019 in district Meerut. Subsequently, the petitioner submitted a representation along with a notary affidavit addressed to the

District Basic Education Officer, Hathras to conduct his counselling but no order was passed on the representation, thereafter petitioner submitted another representation in the shape of reminder on 3.5.2019. Since no action has been taken, the petitioner has preferred the present writ petition.

Heard learned counsel for the parties.

With the consent of learned counsel for parties, the matter is heard finally and disposed of at the admission stage.

In the facts and circumstances of the case, the present writ petition is disposed of with a direction to the petitioner to submit a fresh representation ventilating all his grievances before respondent No.4/District Basic Education Officer, Hathras along with a certified copy of this order within a period of one week from today.

If such a representation is made, respondent No.4 is directed to pass appropriate orders on the said representation within a period of three weeks thereafter.

With the aforesaid observations, the writ petition is disposed of.
