The petitioner is permitted to implead the Director of Education, Madhyamik as respondent no.5 to the instant petition during course of the day.
The petitioner is Principal of Mahatma Gandhi Inter College, Dalanchhapra, District Ballia, a recognized institution under the U.P. Intermediate Education Act, 1921. He has filed the instant petition seeking a mandamus commanding the respondents to grant prior permission as envisaged under Ch. III Regulation 101 of the Regulations framed under the U.P. Intermediate Education Act, 1921, to fill up vacant posts of class IV employees in the institution.
Learned Standing Counsel very fairly states that respondent no.5 will take decision in the matter within such time as may be directed by this Court.
Accordingly, the fifth respondent is directed to take decision in respect of the prayer made by the petitioner within a period of six weeks from the date of receipt of certified copy of this order. Soon thereafter, the third respondent shall pass consequential order.
The petition stands disposed of accordingly.
