Heard Sri Anil Kumar Dube holding brief of Sri D.K.Goswami,learned counsel for the petitioner, learned Standing Counsel for respondent No.1, Sri Prem Prakash Yadav, learned counsel for respondent no. 4.

The petitioner has preferred the present writ petition with the prayer to direct respondent no. 2 and 3 to transfer the petitioner from Primary School Sardar Nagar, Vikas Khand-Shahabad, Hardoi to any other Primary School in district Bijnor.

It is cotented by learned counsel for the petitioner that the petitioner is a resident of district Bijnor. The husband of the petitioner viz. Kamlesh Kumar was appointed as Cleaner (Safai Karmi) in the office of District Panchayat Raj Adhikari, Bijnor on 4th October, 2008 and since then he is working there.

The petitioner was appointed as Assistant Teacher in Primary School Sardar Nagar,Vikas Khand Shahabad, Hardoi in the year 2016 and since then she is working there. It is contented that work place of the petitioner is far away from district Bijnor. The petitioner has also referred transfer policy of the State Government dated 4th June, 2014. It is further contented that she has made various representations to the authorities for his transfer and sicne no decision was taken she has preferred this petition before this Court.

In view of the aforesaid, this petition is disposed of with the direction to the petitioner to submit fresh representation along with a certified copy of this order before the respondent no. 2- Secretary, Basic Shiksha Parishad, Allahabad within two week from today. In the event such a representation is made, the respondent no. 2 is directed to pass a reasoned speaking order on the said representation within a period of two months thereafter.

With the aforesaid observation, this writ petition stands disposed of.

It is made clear that this Court has not expressed any opinion on

merits of the case and the authority concern shall pass order independently, in accordance with law.
