The petitioner has preferred this public interest litigation for the following reliefs:

" (A) In view of the facts and circumstances of the case, it is expedient in the interest of justice that this Hon'ble Court may graciously be pleased to transfer the investigation of this matter to the Crime Branch for Crime Investigation Department (CBCID) for quick and impartial enquiry and investigation.

(B) In view of the facts and circumstances of the case, it is expedient in the interest of justice that this Hon'ble Court may graciously be pleased to direct the Resp. No. 4 to decide the pending representation of petitioner."

On 01st March, 2019 this Court has directed the learned Standing Counsel to seek instructions in respect of present status of investigation.

Sri Rajiv Singh, learned Standing Counsel has produced the status report, which is taken on record. We have perused the status report which indicates that the statement of certain persons have been recorded and the investigation is under progress.

We have heard Ms. Manisha Chaturvedi, learned counsel for the petitioner, Sri Rajiv Mishra, learned Standing Counsel and perused the material on record.

Taking into consideration facts and circumstances of the case we dispose of this public interest litigation with a direction

upon respondent no. 4 - Senior Superintendent of Police, Mathura to ensure that the investigation be completed expeditiously, preferably within three months and the police shall submit a report in terms of Section 173(2) of Cr.P.C.

The Senior Superintendent of Police, Mathura shall send compliance report to the Registrar General of this Court who shall place the said report on the record of this case.
