Present appeal under Section 19 of the Family Court Act, 1984 has been filed assailing the judgement and order dated 29.1.2019 passed by the Principal Judge, Family Court, Etawah, wherein an interim maintenance of Rs.1000/- per month and lump sum litigation expenses of Rs.3000/- has been awarded under Section 24 of the Hindu Marriage Act in proceedings pending under Section 9 of the Hindu Marriage Act.

Appellant was married to the opposite party according to Hindu rites and customs on 29.1.2016. After the aforesaid marriage some dispute arose between the parties. According to the appellant, the opposite party went to her parent's house in January, 2017. The appellant filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal right. In the said proceedings an application under Section 24 of the Act was filed by the opposite party claiming interim maintenance of Rs.15,000/- per month and lump sum litigation expenses of Rs.20,000/-. The aforesaid application was contested by the appellant, who filed his reply.

The Principal Judge, Family Court on 29.1.2019 partly allowed the application of the opposite party and directed the appellant to pay Rs.1000/- as interim maintenance and Rs.3000/- as lump sum litigation expenses.
