In the public interest litigation there is no declaration in terms of sub-rule (3-A) of Rule-1 of Chapter XXII of the Allahabad High Court Rules, 1952.
Earlier, we have granted time to learned counsel for the petitioner to file a supplementary affidavit to make the declaration in terms the aforesaid Rules. Today, he has filed a supplementary affidavit. Again the said declaration is not made therein.
In view of the above, the public interest litigation is dismissed with liberty to the petitioner to file a better petition afresh. Instructions received by learned Standing Counsel is taken on record.
No order as to costs.
