Heard learned counsel for the petitioners and Sri A.K. Goyal, learned Additional Chief Standing Counsel for the State.
The petitioner has prayed for a direction upon the Nagar Panchayat Phaphund, Auraiya to restart the slaughter house in the area of Nagar Panchayat Phaphund, Auraiya.
Sri A.K. Goyal, learned Additional Chief Standing Counsel, has informed that U.P. Municipal Corporation Act 1959, the Municipalities Act 1916, Uttar Pradesh Kshettra Panchayats and Zila Panchayats Act, 2018 have been amended in January, 2018 initially by separate ordinances which have been replaced by Amendment Act, 2018 in the aforesaid three Acts, whereby the provision providing for respective Local Bodies to construct and maintain slaughter house has been omitted. He has also relied upon similar order of this Court dated 27.3.2019 passed in Public Interest Litigation (PIL) No. 88 of 2019. He further states that the petitioner can approach the authorities under the Food Safety & Standards Act, 2006 for grant of prmission.
In view of the above, the writ petition stands disposed off with liberty to the petitioner to apply for and obtain requisite permission under the Food Safety & Standards Act, 2006, if so advised.
