By order dated 4.5.2018, office was directed to trace out the affidavit of compliance filed by the respondent-State.
Learned Standing Counsel has invited the attention of the Court to Paragraph nos.5 and 6 of the affidavit of compliance, wherein it is stated that Arazi nos.263 and 293, which was encroached upon by respondent no.5. The said encraochment has been removed by respondent no.5 from the said Arazi and, further digging work has completed for establishing a pond in its original shape. Coloured photographs of the construction (pond) has been appended as Annexure 1 to the affidavit.
In view of the above, the Public Interest Litigation has become infructuous.
Accordingly, the Public Interest Litigation is dismissed as infructuous.
