This appeal has been preferred by the Insurance Company namely, United Insurance Company Ltd. against the judgement and award dated 16.7.2004 passed by Additional District Judge, Court No.XVII, Allahabad/M.A.C.T., Allahabad in MACP No.01 of 1998 which has been set aside on the application moved by the State before the MACT under Order IX Rule 13 C.P.C. by its order dated 10.1.2012 whereafter a fresh judgement was passed in MAC No.01 of 1998 on 27.2.2014.
The judgement and award dated 16.7.2004 having been set aside, the appeal preferred against the aforesaid judgement and award by the Insurance Company has become infructuous and is accordingly dismissed as such.
