This appeal has been preferred by the Insurance Company namely, United Insurance Company Ltd. against the judgement and award dated 16.7.2004 passed by Additional District Judge, Court No.XVII, Allahabad/M.A.C.T., Allahabad in MACP No.01 of 1998 which has been set aside on the application moved by the State before the M.A.C.T. under Order IX Rule 13 C.P.C. by its order dated 10.1.2012 whereafter a fresh judgement was passed in MAC No.01 of 1998 on 27.2.2014.
We have been informed by learned counsel for the appellants that the impugned judgement and award dated 16.7.2004 has been recalled and set aside on the application moved by the State respondent no.3 under Order IX Rule 13 C.P.C. Since the impugned judgement and award impugned by the appellant in this writ petition has been set aside, in our opinion, this appeal has become infructuous and is dismissed as such.
