It is reported that U.P. Electricity Board's Advocate Sri S.P. Mehrotra has been elevated to the Bench. The paper-book was to be filed in the year 1997, which has yet not been filed.
In these circumstances, I have no other option but to dismiss the appeal of 1993 for non-prosecution as the appellants were under an obligation to appoint any Advocate once their Advocate has been elevated. The counsel appointed by it has been elevated and has already been retired also. Despite that, no counter-affidavit has been filed.
In these circumstances, the appeal is dismissed for want of prosecution.
