This revision has been filed against the judgment and order dated 27.05.1996 passed by Additional Sessions Judge, Kannauj, District Farrukhabad convicting the revisionist under Section 411 I.P.C. and sentence for a period of one year simple imprisonment in Criminal Appeal No. 19 of 1991 which arises out against the original Criminal Case No. 10 of 1990 (State Vs. Rakesh and Others).

Heard learned counsel for the revisionist, learned A.G.A. and perused the record.

Learned counsel for the revisionist has submitted that matter is very old and he prays only with regard to the sentence. The revisionist has filed this revision against the aforesaid impugned order passed by the court below in the year 1996 which has been heard today after laps of more than 24 years. Hence in these circumstances, this Hon'ble Court may take lenient view and graciously modify the sentence awarded to the revisionist.

Having heard learned counsel for the parties, considering the facts and circumstances of the case, I am of the view that conviction order passed by the Magistrate and Sessions Judge is confirmed. But the sentence part of the impugned order dated 27.05.1996 is modified to 3 months simple imprisonment. Period of previous imprisonment shall be set off from this sentence. It is also directed that revisionist will surrender within seven days from the date of passing of the order before the trial court to serve out the remainder of sentence.

A copy of this order be communicated to the trial court concerned for necessary compliance.

The revision is, accordingly, disposed of to the aforesaid extent.
