From perusal of record, it appears that the revisionist was directed to deposit necessary expenses required under the rules for summoning the lower court record. The order dated 20.9.2013 passed by this Court shows that as per office report dated 1.8.2013, the expenses with regard to summon the lower court record has not been deposited and, therefore, revisionist was directed to comply with the order dated 16.2.2005. On 08.11.2013 when this case was listed, it was passed over on the illness slip of Mr. Sudhanshu Srivastava, learned counsel for the revisionist.
This revision is of the year 2005 which is still awaiting an order of admission. It has been filed against the order of acquittal and without lower court record, it is not possible for this Court to hear the matter on admission. Lower court record has not yet been received on account of latches on the part of revisionist in not depositing the requisite expenses for summoning the lower court record.
Since no one is present on behalf of the revisionist even in revised list, the revision is dismissed for non compliance of orders of this Court and in default. Interim order, if any, stands vacated.
