This revision has been filed against the order dated 06.01.2003 passed by Judicial Magistrate-Ist, Bulandshahar in Misc. Case No. 315 of 2000 (Sharda Devi Vs. Ramesh Chand) by which the learned Magistrate has passed an order for issuing recovery warrant for the recovery of award of maintenance granted in favour of opposite party no. 2 in an application under Section 125 Cr.P.C.

From the perusal of the record, it appears that vide order dated 10.02.2003 while issuing notice to opposite party no. 2, the operation of the impugned order was stayed on condition that the revisionist shall deposit Rs. 25,000/- within 10 days and remaining amount of Rs. 25,000/- before or on 30th of April, 2003.

Perusal of the impugned order shows that the learned Magistrate do not believe the contention of the husband that Rs. 50,000/- was paid by him to the wife under a notarized settlement and therefore the recovery warrant was issued.

It is a revision of the year 2003 and it appears that still this revision is awaiting admission.

On the basis of above discussion, I find no material irregularity or illegality or jurisdictional error in the impugned order.

The revision lacks merit, hence dismissed.
