Heard learned counsel for revisionists as well as learned AGA for the State and perused the record.

This Criminal revision has been preferred by Satya Kumar Mishra, Resham Devi, Susheela Devi, Anil Kumar Mishra and Shyam Kumar Mishra against State and Smt. Siddho Devi challenging order dated 17.11.2018 passed by 10th Additional District & Sessions Judge, Kanpur Nagar in S.T. No. 412 of 2017(State vs. Santosh Kumar Mishra and others),Police Station Kalyanpur, District Kanpur Nagar whereby revisionists were summoned summoned under section 319 Cr.P.C. for trial under Section 498A, 304-B IPC and 3/4 D.P. Act.

Learned counsel for the revisionists submitted that impugned order is illegal and against fact and law.

Learned AGA opposed and submitted that the impugned order is just and legal.

From perusal of record, it transpires that after examination of P.W.-1 Siddho Devi, P.W.-2 Arun Kumar and P.W.3 Varun Kumar, trial Court found prima facie evidence and thereafter passed impugned order. This Court finds no illegality in the impugned order. The revision is dismissed.

However, it is observed that in case the revisionists surrender and apply for bail within two months from today, the same shall be considered and decided in accordance with law. For a period of two months from today, no coercive action shall be taken against the revisionists.
