Learned counsel for the revisionist submitted that an FIR was registered on 28.09.2018 by victim's father Vinod Kumar under sections 363 and 366 IPC, P.S. Atrauli, District Aligarh with the allegation that on 25.09.2018 at abut 2.00 P.M., his minor daughter Rashmi, aged about 13 years was enticed away/kidnapped by Kaushal Kumar alias Kushal Pal Singh whereupon the perturbed couple filed Criminal Misc. Writ Petition No. 37701 of 2018 (Kaushal Kumar @ Kushal Pal Singh and others v. State of U.P. and others) wherein vide order dated 20.12.2018, coordinate Bench of this Court protected the liberty of the petitioners and directed the applicant to get her statement recorded under section 164 Cr.P.C. and also for her ossification test for determination of her age. The statement recorded under section 164 Cr.P.C., of the victim girl, annexed as annexure to the revision, wherein the she in no uncertain terms stated that she has joined the company of Kaushal Kumar @ Kushal Pal Singh out of her own sweet will and volition and solemnized marriage in with him six months prior to the recording of the statement, in Arya Samaj Mandir, Tilapata, Greater NOIDA, G.B. Nagar and living peacefully with him as has wife. He further submitted that as per medical report, age of the victim has been opined to be about 18 years.
