Heard the learned counsel for the revisionists, learned A.G.A. for the State and perused the record.

The learned counsel for the revisionists, who preferred this revision, challenging the order dated 19.4.2019 passed by the Additional Sessions Judge, Court No. 3 Kaushambi, in S.T. No. 131 of 2016( State Versus Indraram Maurya and others) arising out of case crime no. 342 of 2013 under sections 323, 325, 308, 504, 506 I.P.C. P.S. Karari district Kaushambi pending in the court of Additional Sessions Judge, Court No. 3, Kaushambi, has confined his prayer to the effect that the prosecution has filed objection 41Kha, containing various contentions of the revisionists, but the learned court rejected the application 41Kha under section 311 Cr.P.C. without assigning any cogent reason.

After having heard the learned counsel for the revisionists, learned A.G.A. and after perusing the record, the order dated 19.4.2019 is hereby set aside.

The revision is allowed.

The matter is remitted back to the court below to pass a fresh order on the application 41 Kha after affording opportunity of hearing to the revisionists.

This exercise shall be undertaken within three months from the date of production of a certified copy of this order before him.
