The instant petition has been filed for a direction upon the respondents to release and handover Truck No. U.P. 70 GT 1487 to the petitioner pursuant to the order of the Sub Divisional Magistrate/S.D.O., Rudhauli, District Basti.

According to the petitioner without any justification the Truck was being detained at Police Station Rudhauli, District Basti even though the Sub Divisional Magistrate had passed order for immediate release of the said Truck.

On 02.04.2019, this Court had required learned A.G.A. to seek instructions as to why Truck No. U.P. 70 GT 1487 was being withheld/detained and whether the same was wanted in any case or not.

Learned A.G.A. has obtained instructions. On the basis of instructions, Sri Deepak Mishra, learned A.G.A. has stated that the petitioner was contacted on telephone to take the Truck No. U.P. 70 GT 1487 but he had not reported to take the Truck and the Truck was found infront of the Police Station in an unclaimed condition and, therefore, it was kept there.

In view of above, we deem it appropriate to dispose off this petition by providing that as soon as the petitioner goes to the Police Station to take delivery of the Truck, the same shall be released forthwith, unless it is wanted in any case.
