The order of the Writ-Court dated 7.1.2016 directed the District Magistrate to decide the application which was to be filed by the petitioner in compliance of order of the Court within three weeks.
An affidavit of compliance has been filed alongwith which the order passed by the District Magistrate dated 7.2.2017 has been brought on record. By the said order, the application of the petitioner filed in compliance of order of the Writ-Court has been decided. The order recites that the proceedings under Section 67 of the U.P. Revenue Code has been initiated against the encroacher. Certain encroachments were also allegedly removed.
No one is present on behalf of the applicant to rebut the stand taken by the opposite party in the affidavit of compliance.
Accordingly, this Court is of the opinion that the direction issued by the Writ-Court has been substantially complied with.
The contempt application is consigned to record.
