Heard Sri V.P. Gupta, learned counsel for applicant, learned AGA for the State and perused the record.

Applicant- Babbu seeks bail in Case Crime No. 321 of 2018, under Sections 147, 325, 307 IPC, P.S. Bisauli, DistrictBudaun.

It has been contended by the learned counsel for the applicant that applicant is innocent and has been falsely implicated in the present case; due to ulterior motive; that the FIR has been lodged after 3 days of the incident, but there is no sufficient explanation for the delay, which shows that the whole prosecution story is bundle of false; it is next contended that sister of first informant had already been married with Vishal, son of applicant before the incident; that there are material contradictions in the statements recorded under section 161 Cr. P.C.; lastly, it is submitted that the applicant has no criminal history; applicant is in jail since 13.12.2018 and in case he is released bail, he will not misuse the liberty of bail and will cooperate in the trial by all means.

Per contra, learned AGA has vehementally opposed the prayer for bail.
