Heard learned counsel for the applicant, learned A.G.A. and perused the record.

It is submitted by learned counsel for the applicant that after lodging the F.I.R. the applicant was arrested and he has been released by the trial court on 6.10.2004 and after releasing on bail he appeared regularly before the trial court till June, 2014 but for his livelihood he went to Ludhiyana for labour work and therefore, due to his non appearance, NBW was issued against him on 30.6.2014 by the trial court and when he returned his home in the Month of June, 2018, he was arrested on 29.6.2018. He further submits that there are no chances of applicant's fleeing away from the judicial process or tampering with the prosecution evidence, and is in jail since 29.6.2018.

Keeping in view the nature of the offence, evidence, complicity of the accused, severity of punishment and submissions of the learned counsel for the parties, I am of the view that the applicant has made out a case for bail.

Let the applicant Pooran Singh involved in Case Crime No. 1887 of 2004 (S.T. No. 130 of 2006), under Sections 147, 148, 149, 307, 336, 332, 302, 323, 504 I.P.C. and Section 7 of the Criminal Law Amendment Act, P.S. Katghar, District Moradabad be released on bail on furnishing a personal bond and two sureties of Rs. 1 Lakh each in the like amount to the satisfaction of the court concerned with the following conditions;

(i)The applicant will not tamper with the evidence during the trial.

(ii) The applicant will not pressurise/intimidate the prosecution witness.

(iii)The applicant will appear before the trial court on the date fixed.

In case of breach of any of the above conditions, the court below shall be at liberty to cancel the bail.
