Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

It is submitted by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the case. It is further contended by learned counsel for the applicant that applicant is not named in the FIR and he is also not named in the statement recorded u/s 161 Cr.P.C. Only extra-judicial confession is recorded after 2-1/2 months before the first-informant. It is next contended by learned counsel for the applicant that co-accused Virendra Lala has already been granted bail by this Court, vide order dated 8.2.2019. He claims parity. The applicant is in jail since 17.11.2018.

Learned A.G.A. has opposed the bail, but concedes the factual aspects of the matter.

Considering the facts and circumstances of the case and without commenting upon the merits of the case, in my opinion, the applicant is entitled to be released on bail.

Let applicant-Narendra @ Pappu, involved in Case Crime No.292 of 2018, under Section 302/34 IPC, Police Station Rajpura, District Sambhal, be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned with the following conditions :-

1.The applicant shall not tamper with the prosecution evidences.

The applicant shall not pressurize the prosecution witnesses.

¶12

3.The applicant shall appear on the date fixed by the trial court.

¶13

The applicant shall not commit an offence similar to the offence of which he is accused, or suspected of the commission, of which he is suspected.

The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence.

In case of default of any of the conditions enumerated above, the order granting bail shall automatically be cancelled.
