Heard Sri Rajeev Sharma, learned counsel for the applicant, learned A.G.A. for the State and perused the record.

It is contended by learned counsel for the applicant that in the present case, 125 grams Alprazolam powder, is alleged to have been recovered from the possession of the applicant. It is further submitted that one more case for recovery of 4.950 kg in Case Crime No. 986 of 2018 under Section 8/20 N.D.P.S. Act, Police Station New Agra, District Agra, regarding the same incident, bail was granted by this Court on 03.12.2018 and in Case Crime No. 984 of 2018 under Section 399 & 402 I.P.C., bail was granted to the applicant on 24.12.2018 from lower court. It is also submitted that there is no compliance of Section 50 of the N.D.P.S. Act. He further submitted that applicant is in Jail since 08.09.2018 and, in case, the applicant is released on bail, he will not misuse the same.

In view of the facts and circumstances of the case and submissions made by learned counsel for the applicant, and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.

Let the applicant Satyavir involved in Case Crime No. 985 of 2018 under Section 8/22 N.D.P.S. Act, P.S. New Agra, District Agra be released on bail on his furnishing a personal bond and two heavy surety each in the like amount to the satisfaction of the Court concerned with the following conditions:-

(i)The applicant will not tamper with the evidence during the trial.

(ii) The applicant will not pressurise/ intimidate the prosecution witness.

(iii)The applicant will appear before the trial court on the date fixed. (iv)The applicant shall report to the police station concerned in the first week of each month to show his good conduct and behavior.

In case of breach of any of the above conditions, the court below shall be at liberty to cancel the bail.
