Learned counsel for the applicant contends that applicant has been falsely implicated; that as per averment made in FIR lodged with inordinate delay on 28.9.2018 Mahipal, brother-in-law (Sala) of his brother Chandrabhan had enticed away daughter of his neighbour, Ram Kishore, on 29.8.2018 due to which Ram Kishore and co-accused persons were inimical to him and after causing death of Chandrabhan hanged him at the hook meant for Ceiling Fan, which was seen by Bhabhi of the first informant, Smt. Saroj; that the statements of Vakeel and Babu have no relevancy; that Smt. Saroj, widow of deceased, in her statement under Section 161, Cr.P.C. has stated that she had gone to her Mayaka on 24.9.2018 and on 28.9.2018 came to know that her husband has been murdered and hanged with Ceiling Fan hook; that applicant had no motive to cause death of deceased; that the case of the applicant is identical to co-accused, Sanju and Omveer, who have been granted bail by the other Benches of this Court vide orders dated 21.1.2019 & 25.1.2019 in Criminal Misc. Bail Application Nos.2531 of 2019 and 3762 of 2019, copies produced for perusal is taken on record; that applicant has no criminal history; that applicant undertakes that he will not misuse the liberty of bail; that applicant is in custody since 22.10.2018.
