Learned counsel for the applicant contends that applicant has been falsely implicated on the basis of suspicion; that as per averments made in the FIR dated 24.6.2017 about one month back a quarrel did take place between Naeem and Amitabh, the deceased and on 23.6.2017 at about 9.00 p.m. his neighbour Waseem, the applicant, fetched Amitabh, who did not return in night and in morning at about 9.20 a.m. his dead body was found in the fields of Mahmood Hasan, as was informed by the village Pradhan and multiple incised wounds were found on the person of deceased; that applicant had no motive to cause death of deceased; that recovery of weapon of crime, blood stained Daanv, blood stained underwear of deceased as well as blood stained clothes of applicant have been falsely planted of which there is no independent witness; that upon arrest of applicant his confessional statement was recorded in police custody to the effect that he had unnatural sexual relations with deceased and since he had made marriage with a girl about three years ago and delivery of his wife was due, deceased was insisting him for deserting his wife and aborting the child upon which he caused death of deceased; that above confessional statement in police custody is not admissible evidence; that the real fact that on the day of incident wife of the applicant was admitted in Lokpriya Nursing Home on account of expected delivery and so throughout night applicant was in hospital except for a short period when he went to attend the Namaj; that co-accused, Nadeem with whom deceased allegedly had a quarrel about 3-4 years back and who was allegedly having enmity with the
