Heard learned counsel for the applicant and learned A.G.A. for the State.

This is a bail application on behalf of the applicant in connection with Case Crime No. 122 of 2018 under Sections 376, 366 and 506 IPC, P.S. Mirhachi, District Etah.

The contention of the learned counsel for the applicant is that he is innocent and has been falsely implicated in the present case and he was not named in the F.I.R. Learned counsel has submitted that the present victim of the incident is major and her date of birth as per high school certificate is 25.05.1998. He has submitted that the girl was in consensual relationship with the present accused. He has further submitted that as per the statement of the girl recorded under Section 164 Cr.PC the accused had carried away her straightaway to Delhi where she lived with the accused till 21.04.2018 in a rented room. Lastly, he submitted that the applicant is languishing in jail since 25.04.2018 and in case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.

Learned AGA has opposed the bail application and fairly conceded that the date of birth of the girl as per her high school certificate is 25.05.1998.
