Applicant- Satveer seeks bail in Case Crime No. 401 of 2018, under Sections 60(1), 62, U.P. Excise Act and Section 272, 273 IPC , Police Station Purkaji, District Muzaffar Nagar.
Heard learned counsel for the applicant and learned AGA for the State.
It has been argued by learned counsel for the applicant that the applicant is innocent and has falsely been implicated; it has been contended the applicant has not been arrested on the spot and the alleged recovery is fake as there is no independent witness; no offence under section 272 IPC is made out as there is no test report about alleged adulteration is available on record, and that applicant is in jail since 19.09.2018having no other criminal history to his credit.
Bail has been opposed by learned AGA on behalf of the State.
The points pertaining to nature of accusation, severity of punishment, reasonable apprehension of tampering the witnesses, prima facie, satisfaction regarding proposed evidence and genuineness of the prosecution case were duly considered.
