Applicant- Mohan seeks bail in Complaint Case No. 105, under Sections 406,420,467,468 IPC , Police Station Khair, District Aligarh.

Heard learned counsel for the applicant, Sri N.K. Singh and Sri A.P.Singh, learned counsel for complainant and learned AGA for the State.

It has been argued by learned counsel for the applicant that the applicant is only marginal witness of the sale deed and is not a beneficiary. It has been further submitted that applicant has no criminal history to his credit and is languishing in jail since 07.02.2019.

Bail has been opposed by learned AGA and learned Counsel for the complainant stating that sale deed has been executed fraudulently by person who is not the owner of the property in question.

The points pertaining to nature of accusation, severity of punishment, reasonable apprehension of tampering the witnesses, prima facie, satisfaction regarding proposed evidence and genuineness of the prosecution case were duly considered.

Without expressing any opinion on the merits of the case, let the above mentioned applicant involved in aforesaid crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-
