It is argued by learned counsel for the applicant that a complaint has been filed regarding the containers contained two gunny bags and nine carton which contained plastic elbow, plastic T, plastic jali & plastic flash jointer (RUD-7); 389 log of red sandal wood of different sizes, approx. from 1.10 feet to 8.09 feet.; 16 gunny bags containing different sizes of red sandal wood; 10 irregular shape of red sandal wood. On examination of the consignment, 10,530 kg. of wooden logs of different sizes and shapes, red sandal logs were found, the valuation of which is Rs.4,42,26,000/-. It has been argued that though the goods are prohibited, but there is no cogent evidence on record to show the involvement of the applicant in the transportation of those goods which were confiscated. There is only confessional statement of Vipin Ranjan as well as applicant and others, on the basis of which the applicant has been falsely implicated in this case. It is next contended that there is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, he shall not misuse the liberty of bail and he is languishing in jail since 18.07.2019. Accordingly, he requests for bail.
