Heard Sri Kamlesh Kumar Tiwari, learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.
This bail application has been preferred by the accused-applicant, who is involved in Case Crime No. 80 of 2015 under Sections 419, 420, 504, 506 I.P.C. Police Station Tiwaripur, District Gorakhpur.
Learned counsel for the applicant submitted that F.I.R. is delayed by three months. The applicant is innocent and has been falsely implicated with ulterior motive. Dispute, if any, is purely civil in nature and Civil Suit No. 1715 of 1993 is already pending but to put pressure upon the applicant present F.I.R. has been lodged with false and fabricated allegations. The applicant has no previous criminal history. He is in jail since 21.12.2018. If he is granted liberty, he will not misuse the same.
Learned A.G.A. has vehemently opposed the prayer for grant of bail.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, I find it a fit case for bail.
