Applicant- Kalloo @ Vrishbhan seeks bail in ST No. 01 of 2003(Case Crime No. 142/02) under Sections 147,148,149,307 and Section 12/14 U.P. Dacoity Affected Area Act, IPC , Police Station Aata, District Jalaun.

Heard learned counsel for the applicant and learned AGA for the State.

Learned Counsel for the applicant submits that it is a case of bail jumping by the applicant since 8.12.2009; the matter relates to firing on police party in which, no injury has been caused and the applicant pursuant to the non bailable warrant , the applicant was arrested and is languishing in jail since 27.10.2018. Lastly, learned Counsel submits that the applicant undertakes before this Court to participate and attend the proceedings of trial on each and every date and he will not misuse liberty of bail.

Bail has been opposed by learned AGA on behalf of the State.

The points pertaining to nature of accusation, severity of punishment, reasonable apprehension of tampering the witnesses, prima facie, satisfaction regarding proposed evidence and genuineness of the prosecution case were duly considered.

Without expressing any opinion on the merits of the case, let the above mentioned applicant involved in aforesaid crime be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-

The applicant shall not tamper with the prosecution evidence, shall cooperate in the investigation or trial and will not indulge in any criminal activity or commission of any crime after being released on bail.

In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.

Learned Trial Court is expected to conclude the trial expeditiously, without granting any unwarranted adjournments to either of the sides, unless required for very compelling reasons.
