It is argued by the learned counsel for the applicant that for the alleged incident dated 12th November, 2016, the first information report has been lodged by one Bhole Nath Yadav i.e. brother of the deceased, namely, Hans Raj Yadav on 27th November, 2016 against two accused persons including the applicant i.e. after fifteen days from the date of alleged incident, for which no plausible explanation has been given, which makes the prosecution case doubtful. In the first information report, it has been alleged that on 12th November, 2016, both the accused persons assaulted the deceased by lathi, stick, fists and kicks due to which he sustained injuries on abdomen and private part of his body. Just after the incident, the informant had admitted the deceased in Beli Hospital, Allahabad where during treatment he died on 14th November, 2016. It has further been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. No specific role has been assigned to the applicant. General and vague allegations have been made against the applicant. The F.I.R. has been lodged at such a later stage that it cannot be believed under circumstances that eye witnesses present on the spot were not examined immediately but their statements were recorded at inordinate delay. It cannot be said as to which of the accused has caused specific injury. It has further been argued by the learned counsel for the applicant that the co-accused, namely, Raju @ Jay Singh has already been enlarged on bail by the Coordinate Bench of this Court vide order dated 7th August, 2019 passed in Criminal Misc.
