Heard learned counsel for the applicant as well as learned AGA for the State and perused the material placed on record.
It is argued by the learned counsel for the applicant that the applicant was initially granted bail by this Court vide order dated 21.10.2013, but as he was arrested in another case, he could not attend the court and consequently non-bailable warrants were issued and applicant was arrested and presently he is in jail since 21.12.2018. Learned counsel for the applicant undertakes that if the applicant is released on bail, he shall attend the court regularly and cooperate with the trial and will not misuse the liberty of bail in any manner.
Per contra learned A.G.A. has opposed the bail prayer of the applicant.
Having considered the submissions of the parties and without expressing any opinion on the merits, let the applicant Ajay alias Aslam, involved in ST No. 13 of 2013 arising out of case crime No. 257 of 2013, under Section 3(1) of U.P. Gangsters and Anti Social Activities (Prevention) Act, PS Gursahaiganj, district Kannauj, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-
In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
