Learned counsel for the applicant submits that applicant has been falsely implicated in this case on account of village party bandi. It is next submitted that the victim of the present case has stated in her statement recorded under Section 164 Cr.P.C. before the Magistrate that the applicant has not committed rape on her, the role of committing rape is attributed to co-accused Shankari. It is next submitted that it appears that the victim is the consenting party to go with co-accused and in the injury report, there is no external or internal injury found on the body of victim; the victim is aged about 16 years old. It is next submitted that the applicant is neither a previous convict nor he has any previous criminal history and he is in jail since 24.1.2019. It is further submitted that there is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses. Keeping in view the above, the applicant is entitled for bail. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.
