Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P and perused the material available on record.

This is second bail application. The first bail application was rejected by this Court vide order dated 30.11.2018.

By way of the instant application, the applicant seeks bail in Case Crime No. 1186 of 2017, under Sections - 420, 406 I.P.C. and Section - 66 Information Technology Act, Police Station - Kotwali City Bijnor, District - Bijnor.

Factual matrix related to facts that approximately Rs. 4,60,000/- were swindled of the victim/informant of this case in the name of earning employment, however argument has been made that only Rs. 25,470/- were deposited in the account of the applicant and this amount, the applicant is ready to pay, if the court permit to do so.

Per contra, learned A.G.A. has submitted that the entire amount duped by the present applicant in company with others stands to Rs. 4,60,000/-.
