Short counter affidavit filed today on behalf of O.P. No.2 is taken on record.
Present application under Section 482, Cr.P.C. has been filed by the applicants for quashing the entire proceedings of Criminal Case No.720 of 2001 (State Vs. Rajeev Kumar and others) arising out of Case Crime No.179 of 2001, under Sections 498A, 323/34, 504, 506(2), IPC, P.S. Jalaun, District Jalaun, pending in the court of Judicial Magistrate, Jalaun as well as all as the consequential proceedings thereon.
Heard learned counsel for the parties.
It is stated by learned counsel for the applicants that the complainant, Smt. Rashmi wife of applicant No.1 died prior to filing of the present application and his brother, Vijay Kumar son of Babu Ram was impleaded as a party through his legal representatives.
In para 5 of the short counter affidavit fled by Vijay Kumar son of Babu Ram, brother of the deceased it is stated that the compromise has been arrived between the parties on 15.11.2018 at the instance of local respected persons and relatives and in view of the above, the complainant has no objection in case the present application under Section 482, Cr.P.C. be allowed by quashing the proceedings of the case in question.
In view of above, the proceedings of the aforesaid case are quashed. The application stands allowed.
