It is not possible for the applicant no.2 to go to Kanpur and doing marpeet there and in this present case on perusing the record as per the medical certificate filed by the applicant dated 7.6.2003, it transpires that the right eye of Smt. Shanti Devi was absolute blind and opined that Smt. Shanti Devi is visually handicapped at the time of the alleged incident and regarding applicant no.2 Rajesh Rai was posted in Primary Health Centre, Sondhi, Jaunpur. As per record of 4.9.1994 he was present on the headquarter on the alleged date of incident. Applicant no.3 Satish Rai is the brother and Lata Rai is the wife of applicant no.4, so on perusing of the record and circumstances of the case, it is clear cut case of counterblast. So, in these circumstances, the application is allowed and the summoning order dated 11.10.1994 and issuance of N.B.W. dated 12.09.2000, issued by the Metropolitan Magistrate-VI, Kanpur Nagar, in Criminal Complaint Case No.2556 of 1994, Krishna Deo Rai vs. Sampati Kumar Sharma and others, under Sections 147, 148, 323, 504 and 506 I.P.C, police station Kaka Deo, district Kanpur Nagar, is hereby quashed.
