Heard Sri R.K. Verma, learned counsel for the applicants, and Sri Abhinav Prasad, learned AGA for the State.
The present application under section 482 Cr.P.C. has been filed with a prayer to quash the entire proceedings of the Case No. 4506 of 2009 (State v. Shaney Alam and others) under section 498A, 323,504 IPC and Section 3/4 of D.P. Act, Police Station- Mahila Thana, District- J.P. Nagar pending in the court of CJM, Amroha, district J.P. Nagar, including charge sheet and other processes issued against the applicants.
This matter was referred to Mediation Centre of this Court on 2.2.2010 with a direction to the applicants that they will deposit Rs.10,000/- within two weeks from the date of order in the account head of the Registrar General, Mediation and Conciliation Centre, High Court, Allahabad. But the office report reveals that applicants have not complied the order dated 2.2.2010 passed by this Court regarding deposit of Rs.10,000/- in the account head of the Registrar General, Mediation and Conciliation Centre, High Court, Allahabad.
Learned AGA has submitted that the applicants are flouting the interim protection granted by this Court vide order dated 2.2.2010 and they did not even bother to comply with the condition mentioned therein and in this way they have flouted the order dated 2.2.2010 passed by this Court, hence, applicants do not deserve any leniency by this Court and therefore on that count itself the matter needs to be rejected.
In view of the above the instant application deserves to be rejected and it is accordingly rejected .
Interim order, if any, stands automatically vacated.
